1. Service Description
Hugo AI Assistant ("Service") is an SMS-based conversational AI assistant that provides personal assistance through two-way text messaging. The Service allows you to:
- Send requests and questions: Text Hugo with tasks like "remind me to do laundry" or "I want to go on a trip"
- Receive intelligent responses: Get helpful answers, follow-up questions, and interactive assistance
- Manage reminders and tasks: Set and receive reminders for things you need to do
- Have conversations: Engage in back-and-forth dialogue to accomplish your goals
This is a conversational service where you initiate contact by texting Hugo, and Hugo responds to help you.
2. Opt-In and Consent
By providing your mobile phone number and opting into our SMS service, you:
- Expressly consent to send and receive text messages with Hugo, an AI assistant
- Understand that you can initiate conversations by texting Hugo at any time
- Consent to receive responses from Hugo, including answers to your questions and reminders you've requested
- Confirm that you are the owner or authorized user of the mobile phone number provided
- Agree that your consent is not a condition of purchase or use of any other services
- Acknowledge that you have read and agree to these Terms and our Privacy Policy
3. Message Flow and Call to Action
How to Opt In:
Users opt into the Hugo AI Assistant service through:
- Direct setup: Having your phone number added to Hugo's authorized users list with your explicit consent
- Personal invitation: Being invited by the service owner with your prior authorization
What Happens After Opt-In:
Upon successful opt-in, you will receive a welcome message similar to:
"Welcome to Hugo, your AI assistant! Text me anytime with requests like 'remind me to do laundry' or 'I want to plan a trip'. I'm here to help! Message frequency varies based on your usage. Reply STOP to cancel, HELP for help. Message and data rates may apply. Privacy: hugo.murmur8.cloud/privacy-policy"
How the Service Works:
- You initiate: Text Hugo whenever you need assistance (e.g., "remind me to call mom tomorrow")
- Hugo responds: Receive helpful responses, follow-up questions, or confirmations
- Conversation continues: Have back-and-forth exchanges until your request is complete
- Reminders delivered: Receive reminders you've set at the scheduled times
Brand Identification:
All messages will clearly identify as coming from "Hugo" or will be clearly in response to messages you've sent.
Message Types and Frequency:
- Conversational responses: Hugo's replies to your messages and questions
- Reminders: Time-based reminders you've asked Hugo to set
- Follow-ups: Context-appropriate check-ins for ongoing tasks or requests
- Clarifications: Questions from Hugo to better understand your requests
Frequency: Message frequency is entirely based on your usage. If you text Hugo frequently, you'll receive more responses. If you set many reminders, you'll receive more notifications. Typical usage ranges from a few messages per week to multiple conversations per day.
Required Disclosures:
Every initial opt-in confirmation includes:

4. Opt-Out Instructions
You may opt out of receiving SMS messages at any time:
- Text STOP: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message
- Confirmation: You will receive a final confirmation message confirming your opt-out
- Contact Us: Email us at murmur8llc@gmail.com to unsubscribe
After opting out, you will no longer receive any messages from Hugo unless you opt in again.

- Text HELP: Reply HELP to any message to receive support information

Example HELP response:

6. Message and Data Rates
Message and data rates may apply depending on your mobile carrier plan. Hugo does not charge for the SMS service itself, but standard text messaging rates from your mobile carrier may apply. Contact your mobile carrier for information about your text messaging plan.
7. Supported Carriers
Our service is available on major U.S. carriers including but not limited to:
- AT&T
- Verizon
- T-Mobile
- Sprint
- And most other major and regional carriers
8. User Responsibilities
You agree to:
- Provide accurate phone number information
- Notify us if your phone number changes
- Not use the service for any unlawful purpose
- Not abuse the service (excessive messaging, attempting to break the system, etc.)
- Understand that Hugo is an AI assistant and may occasionally make mistakes
- Not share sensitive personal information (passwords, SSN, financial details) via SMS
- Use the service in good faith for personal assistance purposes
9. Service Availability
While we strive for 100% uptime, we do not guarantee uninterrupted service. Message delivery may be affected by:
- Mobile carrier outages or issues
- Network congestion
- Device availability and settings
- Scheduled maintenance
10. Modifications to Service
We reserve the right to modify, suspend, or discontinue the service at any time. Material changes to these Terms will be communicated via SMS or email to active subscribers.
11. Limitation of Liability
Hugo and its operators shall not be liable for:
- Delayed or undelivered messages
- Errors, inaccuracies, or misunderstandings in AI-generated responses
- Actions taken based on Hugo's suggestions or recommendations
- Missed reminders due to technical issues or carrier problems
- Charges from your mobile carrier
- Issues arising from mobile carrier service interruptions
- AI limitations or incorrect interpretations of your requests
Important: Hugo is an AI assistant designed to be helpful but should not be relied upon for critical, emergency, or life-safety situations. For emergencies, always contact appropriate emergency services (911, etc.).
12. Privacy
Your use of this service is also governed by our Privacy Policy. We do not share your mobile phone number with third parties for marketing purposes. Please review our Privacy Policy for complete details on data collection and use.
13. Governing Law
These Terms are governed by the laws of the United States and the State of Michigan, without regard to conflict of law provisions.
